These Terms of Service, Acceptable Use Policy, and Service Level Agreement, collectively the Agreement, govern your access to and use of all websites, hosting services, game server hosting, virtual servers, dedicated resources, control panels, billing systems, support systems, software, APIs, and related products provided by Sculk Hosting, LLC.
By creating an account, placing an order, renewing a service, accessing the client area, using a control panel, submitting a ticket, or otherwise using the Services, you agree to be bound by this Agreement. If you do not agree, you must not use the Services.
For purposes of this Agreement:
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to purchase or use the Services.
If you are using the Services on behalf of a company, organization, community, server network, or other legal entity, you represent that you have authority to bind that entity to this Agreement.
If you are under 18, you may only use the Services with the consent and supervision of a parent or legal guardian. That parent or legal guardian is responsible for your use of the Services, payments, Content, and compliance with this Agreement.
We may refuse service, suspend service, or terminate accounts where we believe the user lacks legal capacity, authority, permission, or valid consent to use the Services.
You agree to provide accurate, current, and complete information when registering, ordering, paying, or communicating with Sculk Hosting.
You are responsible for maintaining the confidentiality of your account credentials, passwords, API keys, two-factor authentication devices, control panel logins, SSH keys, billing credentials, and email accounts.
You are responsible for all activity occurring under your Account, whether authorized by you or not, unless caused solely by Sculk Hosting's proven gross negligence or willful misconduct.
You must immediately notify us at support@sculkhosting.com if you suspect unauthorized access, credential compromise, fraudulent use, or any security issue involving your Account or Services.
We are not responsible for losses caused by weak passwords, compromised email accounts, shared credentials, malware on your devices, leaked API keys, social engineering, or your failure to maintain reasonable security practices.
We may require identity verification, billing verification, phone verification, email verification, fraud screening, or additional information before activating, continuing, or restoring Services.
All orders are subject to review, fraud screening, resource availability, payment verification, and acceptance by Sculk Hosting.
We may accept, reject, cancel, or manually review any order at our discretion.
A payment receipt, invoice, automated email, or pending order confirmation does not guarantee that an order has been accepted or provisioned.
Service activation times are estimates only. We are not liable for delays caused by fraud checks, payment processor delays, third-party systems, stock limitations, upstream provider delays, software issues, abuse review, or events outside our reasonable control.
We may correct pricing errors, configuration errors, stock errors, promotional errors, invoice errors, or accidental service descriptions at any time. If a material correction affects your active order, we may allow you to cancel the affected Service and receive a refund for unused prepaid time, unless the issue was caused by fraud, abuse, chargeback activity, or violation of this Agreement.
You agree to pay all fees associated with your Services, including recurring fees, setup fees, upgrade fees, overage fees, add-on fees, late fees, taxes, transaction fees, and any other charges shown at checkout, on an invoice, or in the client area.
Unless otherwise stated, Services are billed in advance.
Recurring Services renew automatically unless canceled before the renewal date through the approved cancellation method in the client area or by contacting support when the client area is unavailable.
You authorize Sculk Hosting and its payment processors to charge your selected payment method for recurring Services, renewals, upgrades, invoices, and applicable taxes.
Failure to pay an invoice by the due date may result in suspension, termination, data loss, late fees, collection activity, or refusal of future service.
We may change pricing at any time. Price changes for existing recurring Services will normally apply at the next renewal term unless otherwise required due to upstream provider changes, tax changes, currency changes, fraud risk, abuse risk, or material business necessity.
Promotional pricing, coupons, discounts, lifetime deals, credits, or special offers may be changed, limited, revoked, or discontinued at any time unless expressly stated otherwise in writing.
You are responsible for keeping your billing information, payment method, contact email, and account details current.
You are responsible for all taxes, duties, levies, governmental fees, sales taxes, use taxes, excise taxes, VAT, GST, or similar charges arising from your purchase or use of the Services.
If we are required to collect taxes, we may add those taxes to your invoice.
If we do not collect a tax that you are legally required to pay, you remain responsible for paying it directly to the appropriate authority.
Unless a specific refund guarantee is displayed at checkout or required by law, all payments are non-refundable once the Service is activated, provisioned, renewed, upgraded, or delivered.
Refunds, if granted, are issued at Sculk Hosting's sole discretion and may be provided as account credit instead of a return to the original payment method.
The following are not eligible for refund unless required by law:
Refund requests must be submitted to support@sculkhosting.com or through the client area.
Refunds may be denied if we determine that you abused the refund policy, violated this Agreement, used excessive resources, engaged in fraud, caused harm to our network, or attempted to obtain free service.
You agree to contact Sculk Hosting before initiating a chargeback, reversal, payment dispute, bank dispute, PayPal dispute, card dispute, or similar action.
Filing a chargeback or payment dispute may result in immediate suspension or termination of all Services, disabling of your Account, loss of data, and a requirement to pay all outstanding balances, chargeback fees, administrative fees, and recovery costs before service is restored.
We may permanently refuse future service to any Customer who files a chargeback or payment dispute without first making a reasonable attempt to resolve the issue with us.
If a chargeback is decided in our favor, we may still require additional verification, payment method changes, or prepayment before restoring service.
You are responsible for canceling Services you no longer want.
Cancellation requests must be submitted through the approved cancellation method in the client area, or by contacting support@sculkhosting.com if the client area is unavailable.
Canceling a Service does not automatically refund previous payments.
Canceling a payment subscription with a third-party payment provider does not automatically cancel your Service with Sculk Hosting. You must cancel the Service through Sculk Hosting's systems.
Upon cancellation, expiration, termination, or nonpayment, your Service may be suspended, deleted, wiped, reallocated, or made unavailable without further notice.
You are responsible for downloading backups and Content before cancellation.
We may suspend, restrict, throttle, quarantine, disable, terminate, or refuse Services immediately, with or without notice, if we determine that:
Suspension does not stop billing unless we expressly state otherwise.
We are not liable for losses, damages, business interruption, data loss, revenue loss, player loss, ranking loss, reputation harm, or other consequences arising from suspension or termination.
You retain ownership of your Content, subject to the rights and licenses necessary for us to provide the Services.
You grant Sculk Hosting a limited, worldwide, non-exclusive, royalty-free license to host, store, transmit, copy, process, back up, display, modify for technical purposes, and otherwise use your Content only as necessary to provide, secure, maintain, troubleshoot, improve, or enforce the Services and this Agreement.
You are solely responsible for your Content, including legality, licensing, accuracy, security, backups, permissions, and compliance with applicable laws.
You represent and warrant that you have all rights, licenses, permissions, and consents necessary to upload, store, transmit, use, and distribute your Content through the Services.
We do not actively monitor all Customer Content but may access, review, preserve, remove, disable, or disclose Content when we believe it is necessary to provide support, investigate abuse, enforce this Agreement, protect our network, protect customers or third parties, comply with law, respond to legal process, prevent fraud or security incidents, resolve technical issues, or satisfy upstream provider requirements.
You are solely responsible for maintaining independent backups of your Content.
Any backup service provided by Sculk Hosting is offered as a convenience only and is not a guarantee against data loss.
Backups may fail, become corrupted, be incomplete, be overwritten, be unavailable, be delayed, or be excluded from certain Services.
We do not guarantee that any backup will be available, restorable, complete, current, or usable.
You agree that Sculk Hosting is not liable for data loss, corrupted data, deleted files, lost worlds, lost databases, failed backups, plugin damage, mod corruption, accidental deletion, account compromise, suspension, termination, hardware failure, software failure, human error, or any loss of Content.
You should regularly download off-platform backups and verify that they work.
Support is available through approved support channels, including support@sculkhosting.com and any official ticket system we provide.
Support scope may vary by Service.
Support generally includes assistance with billing, provisioning, basic troubleshooting, network status, hardware-related issues, control panel access, and issues caused by Sculk Hosting-controlled infrastructure.
Unless expressly included in your plan, support does not include:
We may refuse support if you are abusive, threatening, repeatedly submitting duplicate tickets, refusing to cooperate, withholding information, violating this Agreement, or demanding services outside your plan.
Support response times are estimates only unless specifically covered by a paid support contract.
You agree to communicate with Sculk Hosting staff professionally and respectfully.
We may suspend, terminate, or refuse service for abusive conduct, including:
We reserve the right to limit support access, require communication through legal@sculkhosting.com, or terminate service where Customer conduct creates a hostile, unsafe, or unreasonable support environment.
Services may include allocated resources such as RAM, CPU, disk space, bandwidth, databases, backups, storage, ports, processes, or allocations.
Unlimited or unmetered features, if offered, are subject to fair use, technical limits, physical limits, abuse controls, and this Agreement.
You may not use shared, game, or budget hosting Services in a way that negatively affects other customers, degrades node performance, causes instability, consumes excessive resources, or exceeds the intended purpose of the plan.
We may throttle, limit, suspend, migrate, or require an upgrade for Services that use excessive resources, including but not limited to:
We may impose technical limits even if not listed on the order page when necessary to maintain platform stability, security, or fairness.
IP addresses, ports, allocations, subnets, DNS records, and other network resources remain the property of Sculk Hosting or its upstream providers.
You receive only a limited right to use assigned network resources while your Service remains active and in good standing.
We may change, remove, null-route, reassign, filter, or replace IP addresses, ports, or network resources at any time for operational, security, abuse, legal, routing, or upstream provider reasons.
Dedicated IP addresses are not guaranteed to remain permanently assigned.
You may not advertise, announce, resell, lease, route, proxy, tunnel, or otherwise use assigned IP resources outside the intended Service without written permission.
We may provide DDoS protection or mitigation on certain Services, but no DDoS protection is guaranteed to stop every attack.
DDoS mitigation may involve filtering, rate limiting, traffic scrubbing, temporary downtime, null-routing, IP changes, firewall rules, or upstream provider action.
We are not liable for downtime, packet loss, latency, false positives, service interruption, or data loss caused by DDoS attacks, mitigation, firewall rules, filtering, abuse, or upstream provider action.
You may not intentionally attract attacks, participate in retaliation attacks, host booter or stresser services, run attack tools, threaten attacks, or use our Services in connection with DDoS activity.
Services repeatedly targeted by attacks may be suspended, migrated, rate-limited, null-routed, or terminated if they create risk to our network or other customers.
You are responsible for ensuring that all software, mods, plugins, jars, scripts, panels, websites, libraries, themes, databases, and other materials installed on your Service are properly licensed and legally permitted.
You may not use pirated, cracked, stolen, nulled, leaked, unauthorized, malicious, or illegally distributed software.
We are not responsible for damage caused by third-party software, plugins, mods, scripts, updates, dependencies, or configuration changes.
You are responsible for maintaining software updates, security patches, plugin compatibility, mod compatibility, and application security unless your plan expressly states otherwise.
Sculk Hosting is an independent hosting provider and is not affiliated with, endorsed by, sponsored by, or officially connected to Mojang, Microsoft, Minecraft, or any other game publisher unless expressly stated.
You are responsible for complying with all applicable game publisher terms, end-user license agreements, community guidelines, monetization rules, and usage restrictions.
We may suspend or terminate Services that violate game publisher rules, intellectual property rights, platform policies, or applicable laws.
The Services may rely on third-party providers, including datacenters, network providers, payment processors, domain registrars, control panel software, DDoS providers, email providers, licensing providers, and software vendors.
We are not responsible for failures, outages, policy changes, price changes, data loss, security incidents, delays, suspensions, or errors caused by third-party providers.
Your use of third-party services may be subject to separate terms and policies.
Your use of the Services is also subject to our Privacy Policy, if separately posted.
We may collect and process information necessary to provide Services, process payments, prevent fraud, comply with law, provide support, secure our systems, and operate our business.
You agree that we may process account information, billing information, service metadata, IP addresses, logs, support communications, security events, and technical data for these purposes.
You are responsible for ensuring that your use of the Services complies with all privacy, data protection, and consumer protection laws applicable to your Content and users.
You may not use the Services to collect, store, or process sensitive personal data, regulated health data, payment card data, government identification data, children's data, or similar high-risk data unless you have written permission from Sculk Hosting and maintain all legally required safeguards.
By creating an Account, placing an order, submitting a form, opening a ticket, or otherwise providing your email address to us, you consent to receive emails from Sculk Hosting related to your use of the Services.
These emails may include:
Where permitted by law, we may also send optional promotional, newsletter, update, or marketing emails if you choose to opt in. You are not required to opt in to marketing emails in order to purchase or use core Services.
You may unsubscribe from non-essential marketing emails at any time using the unsubscribe link in the email or by contacting us. Even if you opt out of marketing messages, you will still receive essential transactional and service-related emails necessary to operate your Account and Services.
You agree that the email address associated with your Account must be valid, monitored, and under your control. You are responsible for receiving and reviewing important notices we send to that address.
You may not use our Services to send spam, unsolicited bulk messages, deceptive messages, phishing emails, or any email activity that violates applicable law or harms our reputation, systems, or third-party providers.
We reserve the right to restrict, suspend, or terminate Services involved in abusive email activity, including conduct that causes blacklisting, deliverability issues, complaints, or upstream enforcement actions.

You may not host, distribute, execute, link to, or facilitate malware, malicious code, exploit kits, ransomware, spyware, keyloggers, stealers, droppers, botnet software, worms, viruses, or other harmful software.
Security research tools may only be used with written authorization and only in lawful, controlled environments that do not affect third parties, Sculk Hosting infrastructure, or other customers.
You may not use the Services to send, relay, facilitate, or support spam, unsolicited bulk messaging, abusive messaging, phishing, scam messages, or deceptive communications.
This applies to email, Discord, forums, websites, game chat, APIs, bots, SMS, social platforms, and any other messaging system.
We may block ports, rate-limit traffic, suspend services, or terminate accounts involved in spam or messaging abuse.
You may not host, store, transmit, or distribute:
You may not use Services for workloads that are abusive, unstable, or inconsistent with the plan type.
Prohibited or restricted uses include:
For game hosting, you may not use the Services to:
Adult content is prohibited unless expressly approved in writing by Sculk Hosting.
Even where lawful, adult content may be restricted due to payment processor rules, upstream provider rules, brand risk, abuse risk, or operational risk.
Content involving minors, exploitation, non-consensual material, trafficking, or illegal sexual content is strictly prohibited and will be reported where appropriate.
You may not use the Services for high-risk regulated workloads without written approval, including:
Sculk Hosting does not provide regulated-compliance hosting unless expressly agreed in a separate written contract.
We may investigate suspected AUP violations.
We may suspend, restrict, throttle, filter, remove content, disable access, report activity, preserve evidence, or terminate Services if we believe an AUP violation occurred or may occur.
We are not required to provide advance notice before taking enforcement action.
We may cooperate with law enforcement, rights holders, payment processors, upstream providers, datacenters, security researchers, and affected third parties.
We may charge administrative fees, cleanup fees, abuse handling fees, or recovery costs caused by your violation of this AUP.
This SLA applies only to eligible paid hosting Services unless expressly excluded.
Sculk Hosting will use commercially reasonable efforts to maintain network and power availability for eligible Services.
Unless a specific plan states otherwise, the monthly uptime target is 99.9% network availability.
This SLA does not guarantee that your specific application, game server, plugin, mod, website, database, software, or configuration will remain online.
If Sculk Hosting fails to meet the 99.9% monthly network availability target for an eligible Service, your sole and exclusive remedy is a service credit.
SLA credits are calculated based on the monthly recurring fee for the affected Service, excluding add-ons, licenses, setup fees, usage fees, taxes, credits, discounts, and third-party charges.
SLA credits are limited as follows:
Credits are issued only as account credit and may not be exchanged for cash.
Total SLA credits for any month may not exceed 50% of the monthly recurring fee for the affected Service.
To request an SLA credit, you must submit a ticket or email support@sculkhosting.com within 7 days after the end of the calendar month in which the alleged downtime occurred.
Your SLA claim must include:
Failure to submit a complete claim within 7 days waives your right to an SLA credit.
Sculk Hosting's internal monitoring, network logs, provider reports, and system records will be the primary basis for determining downtime and credit eligibility.
Downtime is not eligible for SLA credit if caused by:
We may perform scheduled or emergency maintenance.
We will attempt to provide notice for scheduled maintenance when reasonably practical.
Emergency maintenance may be performed without advance notice when necessary to protect security, stability, data integrity, or network operations.
Maintenance windows are excluded from SLA calculations.
SLA credits are your sole and exclusive remedy for downtime, outage, network interruption, packet loss, latency, service unavailability, or performance degradation.
You are not entitled to damages, refunds, chargebacks, lost profits, lost revenue, lost players, lost data compensation, consequential damages, or additional remedies for downtime.
We may modify, upgrade, downgrade, migrate, replace, move, or reconfigure Services, nodes, hardware, software, IP addresses, locations, storage, networks, or control panels when reasonably necessary.
We may migrate Services to different hardware, nodes, locations, or providers for security, performance, maintenance, abuse mitigation, cost, availability, or business reasons.
We will attempt to minimize disruption but do not guarantee that migrations will be uninterrupted or error-free.
You are responsible for maintaining backups before any migration, upgrade, downgrade, cancellation, or major change.
We may offer beta, experimental, pre-release, early-access, or test features.
Beta features are provided as is, without warranty, support guarantee, SLA, or availability guarantee.
We may modify, break, remove, limit, or discontinue beta features at any time.
You should not rely on beta features for production use.
You may not resell the Services unless your plan expressly permits resale or we provide written authorization.
If resale is permitted, you remain fully responsible for your customers, users, subusers, content, abuse, payments, support obligations, and compliance with this Agreement.
Your customers do not become direct customers of Sculk Hosting unless we agree in writing.
We may hold you responsible for violations caused by your customers, users, staff, or subusers.
You are responsible for all subusers, staff members, developers, administrators, collaborators, and other users you invite or allow to access your Services.
Actions by your subusers are treated as actions by you.
You must ensure that subusers comply with this Agreement.
We are not responsible for damage caused by subusers, including file deletion, server deletion, configuration changes, backups, plugin installs, malicious actions, or account misuse.
You agree not to disclose non-public information obtained from Sculk Hosting, including internal systems, security procedures, private communications, unreleased features, private pricing, credentials, API keys, vulnerabilities, or confidential support information.
Sculk Hosting will take reasonable steps to protect your non-public account information, subject to this Agreement, law, support needs, security requirements, and operational necessity.
The Services are provided as is and as available.
To the maximum extent permitted by law, Sculk Hosting disclaims all warranties, whether express, implied, statutory, or otherwise, including:
We do not guarantee that the Services will be uninterrupted, secure, error-free, immune from attack, compatible with all software, free of data loss, or suitable for any specific purpose.
To the maximum extent permitted by law, Sculk Hosting, LLC and its owners, members, managers, employees, contractors, vendors, affiliates, agents, licensors, suppliers, and providers will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, including:
To the maximum extent permitted by law, Sculk Hosting's total cumulative liability for any and all claims arising out of or related to the Services or this Agreement will not exceed the amount you paid to Sculk Hosting for the affected Service during the one month immediately before the event giving rise to the claim.
If you paid nothing for the affected Service, Sculk Hosting's total liability will be zero dollars.
Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you. In those jurisdictions, liability is limited to the greatest extent permitted by law.
You agree to defend, indemnify, and hold harmless Sculk Hosting, LLC and its owners, members, managers, employees, contractors, vendors, affiliates, agents, licensors, suppliers, and providers from and against any claims, damages, losses, liabilities, demands, judgments, settlements, penalties, fines, costs, and expenses, including reasonable attorneys' fees, arising from or related to:
We may control the defense of any matter subject to indemnification, and you agree to cooperate with us.
Before filing a lawsuit, arbitration, chargeback, regulatory complaint, or formal dispute, you agree to contact legal@sculkhosting.com and attempt to resolve the dispute informally.

This Agreement is governed by the laws of the State of Illinois, without regard to conflict-of-law principles.
Subject to the arbitration provision below, any court proceeding must be brought in the state or federal courts located in Illinois, and you consent to personal jurisdiction and venue in those courts.
To the maximum extent permitted by law, you and Sculk Hosting agree that disputes, claims, or controversies arising out of or relating to this Agreement, the Services, billing, support, suspension, termination, data loss, or your relationship with Sculk Hosting will be resolved by binding individual arbitration rather than court.
The arbitration will be conducted in Illinois, in English, by a neutral arbitrator.
The arbitrator may award individual relief only and may not award relief on behalf of others.
Either party may bring qualifying claims in small claims court instead of arbitration.
Either party may seek temporary or emergency injunctive relief in court for intellectual property misuse, unauthorized access, security threats, abuse, nonpayment, or misuse of Services.
To the maximum extent permitted by law, you and Sculk Hosting agree that disputes must be brought only in an individual capacity and not as a plaintiff, class member, representative, private attorney general, or participant in any class, collective, consolidated, or representative proceeding.
To the maximum extent permitted by law, you and Sculk Hosting waive the right to a jury trial for any dispute not subject to arbitration.
To the maximum extent permitted by law, any claim arising out of or related to this Agreement or the Services must be filed within one year after the claim arose, or it is permanently barred.

Legal notices sent by email are for notice purposes only and do not replace service of process where formal legal service is required by law.
Service of process must be made through Sculk Hosting's registered agent or as otherwise permitted by applicable law.
Notices to you may be sent by email, ticket, client area notification, dashboard notice, invoice message, website notice, or other reasonable method.
You are responsible for maintaining a valid email address on your Account.
Sculk Hosting is not liable for delay, failure, outage, data loss, interruption, or nonperformance caused by events outside our reasonable control, including:
We may update this Agreement at any time.
Updated terms may be posted on our website, in the client area, by email, or through another reasonable method.
Changes are effective when posted unless a later effective date is stated.
Your continued use of the Services after changes become effective means you accept the updated Agreement.
If you do not agree to updated terms, you must stop using the Services and cancel your Services before the next renewal.
Material changes will not apply retroactively where prohibited by law.
You may not assign, transfer, delegate, sell, or sublicense your rights or obligations under this Agreement without written permission from Sculk Hosting.
Sculk Hosting may assign or transfer this Agreement, Accounts, Services, assets, contracts, rights, obligations, or customer relationships in connection with a merger, acquisition, sale, restructuring, financing, change of control, or business transfer.
If any provision of this Agreement is found invalid, illegal, or unenforceable, the remaining provisions remain in full force.
The invalid provision will be modified to the minimum extent necessary to make it enforceable, or replaced with an enforceable provision that most closely reflects the original intent.
Failure by Sculk Hosting to enforce any provision of this Agreement does not waive our right to enforce that provision later.
Any waiver must be in writing and signed by an authorized representative of Sculk Hosting.
This Agreement, together with any posted policies, order forms, invoices, plan descriptions, Privacy Policy, and written addendums, forms the entire agreement between you and Sculk Hosting regarding the Services.
This Agreement supersedes all prior or contemporaneous discussions, statements, understandings, advertisements, or representations regarding the Services.
If there is a conflict between this Agreement and a plan description, invoice, support message, advertisement, or website statement, this Agreement controls unless a written contract signed by Sculk Hosting expressly states otherwise.
